MINUTES OF THE EXTRA PARISH COUNCIL MEETING
Thursday 5th August 2021
Held in Follifoot Village Hall, following the relaxation of Government guidelinesregarding the coronavirus pandemic.
PRESENT: Chairman N MacDermid, Vice Chairman A Dewsnip, Councillors C Dickinson, J Locke T. Martin and T Hall. In attendance, M Richards (Clerk) 10 residentsand two representatives from Rudding Park Ltd.
1.Apologies: Apologies for absence were received and accepted from Cllr.S Riley.
2. Declaration of Interest and Notification of changes in the Members’
Register of Interest: None.
3. Public Participation session: The Chairman welcomed the ten residents and
Rudding Park senior management to the meeting and confirmed that they
were able to comment on any issues raised.
4. Planning:
Applications Received
a)21/02604/FUL – Rudding Park Hotel – Change of use of parkland to
holiday use and siting of 8 holiday lodges and ancillary communal service
building for temporary staff accommodation with access and landscaping
works.
The representatives from Rudding Park explained in detail the proposals for the development. The lodges are in fact purely to provide temporary (possibly up to 6 months) staff accommodation. The existing hedgerow does provide some screening but this will be extended. A resident observed that the development would have an adverse effect on the view from houses on Rudding Dower and he was disappointed that these residents had not been involved in the planning process as consultees. He was concerned about possible lighting and noise pollution and stressed the need for extra screening. The Rudding Park representatives responded positively assuring that any car movements would be restricted to the staff car park and there would definitely be no noise after 11pm (a strictly enforced requirement of Staff Rules) Furthermore, the already planted Portuguese Laurel would be extended to provide the additional screening requested. It was also stressed (in response to another concern) that there was positively no intention for any further development along these lines and there was no question of these lodges being converted at any time in the future to holiday accommodation.Councillors discussed and agreed to support the application but with the following provisos:
i) Approval be conditional on the provision of extra screening between the development site and Rudding Dower;
ii) A Planning condition is included that no further expansion of this staff accommodation is to be applied for in the future;
iii) No vehicles will be taken past the staff car park
iv)Use of the lodges is strictly for the provision of temporary staff accommodation.
b) 21/03156/FUL – Bryden House Pannal Road Follifoot – Erection of two
storey side extension with dormer and single storey rear extension.
Councillors reviewed the existing and proposed site plans. Comments were made over the increased size of the footprint but councillors were content that planners would take this into account as part of their review process. It was also noticed that on the published plan it appears that no access to the proposed new bedroom has been provided! It was agreed that the response would be to support the application but with the additional comments that “the Parish Council seeks assurance that the proposed increase in footprint complies with planning regulations, particularly in terms of scale. In addition, clarification is sought over access to the proposed first floor bedroom – there is no door or access point shown on the plan”
c) 21/032316/FUL – Construction of agricultural access road, Land Adjacent
to Church Farm Plompton Road, Follifoot.
Councillors had some concern over the possibility of a potential future application for further development of this site and also the detriment to the grassy area but, on balance agreed that the response should be to neither support nor object to the application but seek assurance that the access road does not exceed the optimal size and construction for the purpose of agricultural access, and also note that the creation of the access road will impact on the visual appearance of this grassed area.
d) 21/01604/FUL – Conversion of agricultural building to form dwelling and
garage, Barnfield, Plompton.
Residents had commented about the damage to the access road caused by construction traffic during previous building works at this property and were concerned that this would be repeated and possibly exacerbated. After further discussion it was agreed that the application would be supported but with the following proviso – “as previous construction work on this site reputedly caused significant damage to the access road, assurance is sought that further disruption and damage will be avoided/minimised during construction and that any further damage caused by heavy construction traffic, is rectified” Decisions
i) 21/02880/PNA – Formation of private way to facilitate access to agricultural
fields – Land Adjacent to Pound, Plompton Road Follifoot.
Application withdrawn.
ii) Erection of single & two storey rear extensions & alterations to fenestration and materials. – 2 Ivy Close Follifoot.
GRANTED
c) Other – for information.
i) Enforcement – 5 Plompton Square, felling of trees in conservation area.
Investigation completed, no action necessary, case closed.
Councillors noted the above decisions.
ii) 7 Plompton Square – use as AirBnB – investigation completed –
retrospective planning application to be submitted. A resident outlined the continuing unsatisfactory issues arising from the use of the property as an AirBnB and its effect on neighbouring properties. The Chairman offered his sympathy but affirmed that nothing further could be done by the Parish Council until a planning application is submitted. Residents would however, be well within their rights to submit complaints to HBC via the Enforcement process.
iii) Notification of Appeal – Follifoot Grange, Shaw Lane, Spofforth
Erection of timber entrance gates and 2.1m stone wall – 21/00036/HOUSER. The Chairman reminded councillors of the circumstances of the original application, which had been supported by the Parish Council. The application as described, would virtually match neighbouring propertiesso it was unclear why it had been refused by HBC. Councillors agreed to await the outcome of the appeal.

11. Other matters
a) Cllr Dickinson reported that he has downloaded data from the VAS and is
working to provide an analysis. He also noted that the sign is activated before
traffic actually enters the 30mph zone. The Chairman suggested that the
SWARCO engineer be contacted for comment and Cllr Dickinson undertook
to make such contact.
b) The clerk requested delegated authority to respond to planning applications
received in the period before the next meeting, if a response extension cannot
be agreed. Councillors agreed, the Chairman stipulating that views of
councillors be sought via email, and aggregated into a response to be
submitted by the clerk.
There being no other business, the meeting closed at 8.45pm.
